Presidente do partido político e fraude às cotas de gênero : legitimidade e litisconsórcio eleitorais

Abstract

Partindo de um julgado específico do Tribunal Regional Eleitoral do Maranhão (TRE-MA), este artigo pretende analisar o papel do presidente ou da presidente de partido político como eventual parte nas ações por fraude à cota de gênero. O estudo apoia-se na crítica da evolução jurisprudencial do tratamento do litisconsórcio e ainda em breve revisão doutrinária correlata. Tanto a causa de pedir (o fenômeno das candidaturas fictícias) quanto o litisconsórcio não têm sido tratados com técnica adequada pelos tribunais brasileiros. Assim, a facultatividade do litisconsórcio em ações por fraude à cota de gênero, sem que mesmo se defina o que seria a fraude, qual o abuso e quem seria o abusador, deixa à margem do escrutínio as figuras centrais de gestão dos partidos políticos.

Starting from a specific judgment of the TRE-MA, this article intends to analyze the role of the president of a political party as an eventual party in the actions for fraud to the gender quota. The study is based on the criticism of the jurisprudential evolution of the joinder of parties and a related doctrinal review shortly. Both the cause of action (the phenomenon of fictitious candidacies) and the joinder of parties have not been dealt with with adequate technique by Brazilian courts. Thus, the optionality of joinder in actions for fraud against the gender quota, without even defining what the fraud would be, what the abuse would be and who the abuser would be, leaves central figures in the management of political parties out of scrutiny.
