A legitimidade da jurisdição constitucional e o ativismo judicial como garantia à preservação do Estado democrático de direito

Abstract

Analisa a jurisdição constitucional e a prática do ativismo judicial como formas legítimas de atuação do Poder Judiciário na defesa de garantias fundamentais e na manutenção do Estado democrático de direito. Examina a nova face da justiça e do direito diante do atual modelo de constituição da pós-modernidade. Procura demonstrar a legítima e necessária postura ativista do judiciário, bem como a função do controle de constitucionalidade como a maior expressão da jurisdição constitucional e o meio pelo qual ela se realiza. O método utilizado foi o dedutivo. O estudo demonstra a legitimidade democrática da jurisdição constitucional e do ativismo judicial, expondo argumentos que evidenciem que estes são os principais responsáveis por manter a chama da democracia acesa e vibrante.It analyzes the constitutional jurisdiction and practice of judicial activism as legitimate forms of judicial power in the defense of fundamental guarantees and maintenance of the democratic state of law. It has the objective of examine the new face of justice and the law before the of the new present model of post-modernity. Wants to demonstrate the necessary and legitimate activist stance of the judiciary, as well the function of control of constitutionality as the highest expression of the constitutional jurisdiction and the means by which it takes place. The method used was deductive. The study defended the democratic legitimacy of constitutional jurisdiction and judicial activism, exposing arguments that evidence these are the ones primarily responsible for keeping the flame of democracy alive and vibrant.
