O caso Trump : comparação com o direito eleitoral brasileiro

Abstract

Apresenta os aspectos de direito eleitoral do caso Trump por meio da comparação do direito eleitoral norte-americano com o direito eleitoral brasileiro, em especial quanto às condições de elegibilidade e causas de inelegibilidade. São elencados os crimes de que Trump é acusado, seu enquadramento jurídico e suas consequências, bem como as questões que serão decididas pela Suprema Corte. O artigo conclui observando que a existência da Justiça Eleitoral e da Lei da Ficha Limpa no Brasil são conquistas que devem ser valorizadas pelo povo brasileiro.It aims at presenting election law aspects of the Trump affair through comparative approach between american election law and brazilian election law, mainly with regard to qualification requirements. It presents the list of crimes Trump is charged of, their legal framework and their implications, as well as the issues submitted to the Supreme Court. The article finds out that the existence of the Election Branch of the Judiciary Power, as well as the Clean Record Act in Brazil are important achievements that deserve to be valued by the Brazilian people.
