Hermenêutica dos direitos fundamentais e soberania popular

Abstract

Procura demonstrar que a efetivação dos direitos fundamentais passa, necessariamente, por um novo modelo de interpretação. O debate orienta duas discussões: a primeira rompe com a hermenêutica clássica, de subsunção, que buscava a teoria formalista da constituição e, a segunda, que manifesta ser imprescindível afirmar a teoria material da Constituição a partir de uma Nova Hermenêutica que aplique suas cláusulas abertas e dê a máxima efetividade e concretude aos direitos fundamentais. Prossegue, afirmando que o direito de sufrágio tutela a dignidade da pessoa humana e se alicerça na representatividade e na soberania popular, no Estado Democrático de Direito e na cidadania, fundamentos da República Federativa do Brasil. Nessa perspectiva, o presente estudo utiliza pesquisa bibliográfica e documental e discorre o direito fundamental de sufrágio em confronto com a decisão do Tribunal Superior Eleitoral no Recurso Ordinário nº 1.497/PB, que cassou os diplomas de Governador e Vice-Governador do Estado da Paraíba, determinando a diplomação do candidato que obteve menos votos

It shows that the enforcement of fundamental rights necessarily requires a new model of interpretation. The debate directs two discussions: first, breaks with the classical hermeneutics of subsumption, which followed after the formal theory of the constitution and the second, which manifests be essential to state material theory of the Constitution from a New Hermeneutics applying its open clauses and give maximum effectiveness and concreteness to fundamental rights. Goes on to state that the right of suffrage protects the dignity of the human person and is grounded in representation and popular sovereignty, the democratic rule of law and citizenship, fundamentals of the Federative Republic of Brazil. From this perspective, this study uses documentary and bibliographical research and discusses the fundamental right of suffrage at odds with the decision of the Superior Electoral Court in the Regular Appeal No. 1497 PB, which annulled the diplomas of Governor and Deputy Governor of the State of Paraíba, given the candidate s graduation he got fewer votes
