A liberdade de expressão e a tutela da Justiça Eleitoral

Abstract

A justiça eleitoral tem como função, a garantia de eleições livres, justas e iguais e para isso possui tantos instrumentos quanto necessários para atingir este objetivo, entre eles, impor limite ao uso da propaganda eleitoral, seja ela extemporânea ou não, coibindo abusos de poder político e econômico que desequilibrem a disputa. O instrumento do controle da propaganda eleitoral em geral não possui uma relação direta com a liberdade de expressão, não sendo esse o télos da justiça eleitoral, senão indiretamente, através da estabilização do modelo democrático. Assim, ao tutelar e controlar a propaganda, seja através de aplicação de multa ou mesmo da retirada de conteúdo em redes sociais ou outros meios de comunicação, a justiça eleitoral está garantindo o equilíbrio do jogo democrático de maneira que é estranha à sua tutela a avaliação dos limites da liberdade de se expressar.

Electoral justice has the function of guaranteeing free, fair and equal elections, and for that it has as many instruments as necessary to achieve this objective, including imposing limits on the use of electoral propaganda, whether extemporaneous or not, curbing abuses of power political and economic that unbalance the dispute. The instrument of electoral propaganda control in general does not have a direct relationship with freedom of speech, which is not the télos of electoral justice, but indirectly, through the stabilization of the democratic. Thus, by overseeing and controlling advertising, whether through the imposition of a fine or even the removal of content on social networks or other media, the electoral justice is ensuring the balance of the democratic game in a way that the evaluation is alien to its guardianship at the limits of the freedom of speech.
