Representação e representatividade no Congresso Nacional e a lei nº 14.192/2021, que versa sobre a violência política contra mulheres

Abstract

O cenário político brasileiro é marcado por aspectos sociais, econômicos e culturais específicos. O país tem desigualdades estruturais que são delineadas por gênero, raça e etnia, sexualidade, idade, região etc. Os espaços político-decisórios no Brasil continuam a refletir essas características. O objetivo deste trabalho é discutir a situação atual da representação descritiva das mulheres no Congresso Nacional, na legislatura de 2019-2023, para refletir sobre como isso implica termos de representatividade. Para aprofundar a questão, foi analisada a Lei nº 14.192, promulgada em 2021, que procura combater a violência política contra as mulheres. A pesquisa se concentra no método dedutivo, com viés qualitativo, baseado em técnicas procedimentais eminentemente bibliográficas e documentais. Com o olhar voltado às questões de gênero e ao marco teórico feminista, explora os temas de representação e representatividade, inclusão, reconhecimento e identidade que giram em torno da violência política baseada no gênero. Com relação à nova lei, as consequências e as repercussões na esfera político-eleitoral brasileira poderão ser melhor vistas na prática, principalmente a partir das eleições de 2022. Resta saber que influência uma representação mais ampla das mulheres nos espaços de tomada de decisão política teria sobre o regime democrático.

The Brazilian political scenario is marked by specific social, economic and cultural aspects. The country has structural inequalities that are delineated by gender, race and ethnicity, sexuality, age, region, etc. The political-decision-making spaces in Brazil continue to reflect these characteristics. The objective of this work is to discuss the current situation of the descriptive representation of women in the National Congress in the 2019-2023 legislature, to reflect on how this implies in terms of representativeness. To deepen the issue, Law n. 14,192, enacted in 2021, which seeks to combat political violence against women. The research focuses on the deductive method, with a qualitative bias, based on procedural techniques that are eminently bibliographical and documental. With a focus on gender and feminist issues, it explores the themes of representation and representativeness, inclusion, recognition and identity that revolve around gender-based political violence. With regard to the new law, the consequences and repercussions in the Brazilian political-electoral sphere will be better seen in practice, especially after the 2022 elections. It remains to be seen what influence a broader representation of women in political decision-making spaces would have on the democratic regime.
