Eleição suplementar : em busca do elo perdido

Abstract

Identifica o conceito de "eleição suplementar" e procura contemplá-lo por meio do estudo da legislação - notadamente o Código Eleitoral de 1965 -, das decisões do Tribunal Superior Eleitoral (TSE) e dos comentários de especialistas em direito eleitoral. O resultado aponta para uma transformação recente no modo como a denominação tem sido significada pela Justiça Eleitoral, o que indica existir uma distinção entre a forma como ela está definida no texto legal e aquela como vem sendo aplicada contemporaneamente. A apreciação das situações fáticas que produzem a convocação da eleição suplementar revela outra peculiaridade do conceito: decisões do Supremo Tribunal Federal e do TSE indicam que as suas causas geradoras extrapolam as previsões do direito eleitoral e suas respectivas normas legais, pois encontram fonte no direito constitucional, na autonomia para organização administrativa dos entes federativos (estados e municípios) para suprir dupla vacância no executivo e, por isso, não exigem e tampouco estão relacionadas à invalidade do processo eleitoral original. Consequentemente, eleição suplementar é provocada por anulação do pleito original, mas também por situações específicas de dupla vacância do mandato.

It identifis the concept of "supplementary election" and seeks to contemplate it through the study of legislation - notably the Electoral Code of 1965 -, the decisions of the Superior Electoral Court and the comments of experts in Electoral Law. The result points to a recent transformation in the way the name has been signified by the Electoral Justice, which indicates that there is a distinction between the way it is defined in the legal text and that as it has been applied at the same time. The appreciation of the factual situations that produce the call for the supplementary election reveals another peculiarity of the concept: decisions of the Supreme Federal Court and the Superior Electoral Court indicate that their generating causes go beyond the predictions of the Electoral Law and their respective legal norms, as they are found in the Constitutional Law, in the autonomy for administrative organization of the federal entities (states and municipalities) to supply double vacancy in the executive and, therefore, they do not demand nor are they related to the invalidity of the original electoral process. Consequently, a supplementary election is caused by the cancellation of the original election, but also by specific situations of double vacancy in the mandate.
