Participação feminina na política : exame da Lei nº 12.034/2009 e a previsão de cotas de gênero

Abstract

Objetiva investigar a participação feminina a partir da promulgação da Lei no 12.034/2009, que instituiu o mínimo de 30% de mulheres nas candidaturas eleitorais. Para tanto, examina as eleições municipais de 2008, 2012 e 2016 em Porto Alegre, especificamente para os cargos proporcionais, a fim de comparar o aumento da participação feminina nos espaços políticos de poder. O método de pesquisa é o hipotético-dedutivo e o método de procedimento é monográfico, com técnica de pesquisa bibliográfica e documental, com base nas estatísticas do Tribunal Superior Eleitoral e na Lei de Acesso à Informação. Pretendese discutir a necessidade de alterações legislativas para o desenho de políticas públicas que garantam maior participação feminina nos espaços da política. Conclui-se que, embora o número de candidaturas tenha apresentado uma ampliação de 90 para 201, as cotas eleitorais pouco têm contribuído para resolver a sub-representação feminina no meio político.

It aims to investigate the female participation from the promulgation of Law n. 12.034/2009, which established the participation of at least 30% of women in electoral applications. To do so, it examines the case of the municipal elections of 2008, 2012 and 2016 in Porto Alegre, specifically for proportional positions, in order to compare the increase of female participation in political power spaces. The method of research is hypothetical-deductive and the method of procedure is monographic, with bibliographical and documentary research, extracted from the Superior Electoral Tribunal and the Law on Access to Information. The intention is to discuss the need for legislative changes to the design of public policies that guarantee greater female participation in the spaces of politics. It is concluded that electoral quotas, although it has increased from 90 to 201 in the number of candidatures, have contributed little to solving female underrepresentation in the political environment.
