Da relação entre poder constituinte e poder constituído no estado plurinacional da Bolívia

Abstract

Analisa a relação entre Poder Constituinte e Poder Constituído no Estado Plurinacional da Bolívia. Partindo-se das profundas mudanças sociais, políticas e constitucionais ocorridas no mencionado país sul-americano desde o início do século, o Poder Constituinte é caracterizado, com apoio da filosofia política de Antônio Negri, como potência permanente e ilimitada que possui a capacidade de construir e efetivar um profundo e autêntico regime democrático, não sendo contido, inclusive, pela própria Constituição do Estado Plurinacional de 2009, que reconhece variados mecanismos de participação política direta e a expressa possibilidade de reforma total do seu texto. Por outro lado, será apontado que, inobstante os avanços em práticas democráticas no contexto boliviano, há o permanente risco de expropriação da potência democrática por parte do círculo restrito do Poder Constituído, subvertendo a liberdade democrática em dominação. Para os propósitos deste trabalho, iremos explicitar o quadro teórico utilizado, apresentar análises de autores especializados na realidade sócio-política boliviana, bem como estudar sua Constituição, legislação e jurisprudência relacionada aos fatos aqui apresentados.

It aims to analyze the relationship between Constituent Power and Constituted Power in the Plurinational State of Bolivia. Starting from the deep social, political and constitutional changes occurred in said South American country since the beginning of the century, the Constituent Power is featured, with support from the political philosophy of Antonio Negri, as permanent and unlimited power that has the ability to build and perform a deep and authentic democratic regime, not being restrained, including, by 2009 Constitution of the Plurinational State, which recognizes several mechanisms of direct political participation and the express the possibility of total reform of its text. On the other hand, it pointed out that despite advances in democratic practice in the Bolivian context, there is a permanent risk of expropriation of democratic power by the narrow circle of the Constituted Power, subverting the democratic freedom in domination. For the puoposes of this papper, we will explicit the theorichal framework, show analysis of expert authors in the bolivian social and policial reality, and study bolivian's Constitucion, legislation and jurisprudence related to the facts presented here.
