O abuso de poder de autoridade religiosa à luz da jurisprudência do Tribunal Superior Eleitoral : uma discussão inicial

Abstract

Na fiscalização das eleições e na proteção do jogo democrático, a Ação de Investigação Judicial Eleitoral é um dos principais instrumentos processuais para resguardar a normalidade e a legitimidade das eleições em face de abusos de poder. A legislação eleitoral prevê expressamente os abusos de poder econômico, de autoridade, político, político-econômico e midiático. Porém, nos últimos anos, o abuso de poder exercido por autoridades religiosas brasileiras tem sido submetido à apreciação do Tribunal Superior Eleitoral (TSE) como uma forma atípica de abuso de poder. Este artigo analisa e discute o entendimento atual do TSE acerca do abuso de poder de autoridade religiosa. A amostra analisada reuniu cinco julgados do TSE proferidos entre os anos de 2016 e 2021. Os resultados obtidos permitem afirmar que a Corte Eleitoral, neste momento, entende que o abuso de poder de autoridade religiosa não pode ser examinado em sede de Ação de Investigação Judicial Eleitoral enquanto figura autônoma de abuso de poder, uma vez que nem a Constituição, nem a legislação eleitoral contemplam a figura do abuso de poder religioso. No entanto, o Tribunal admite a análise do abuso de poder religioso, se correlacionado com alguma das formas típicas de abusos de poder.

In monitoring elections and protecting the democratic game, the Judicial Electoral Investigation Action is one of the main procedural instruments to protect the normality and legitimacy of elections in the face of abuses of power. Brazilian Electoral legislation expressly provides for abuses of economic, authority, political, political-economic, and media power. However, in recent years, the abuse of power exercised by Brazilian religious authority has been submitted to appreciation by the Superior Electoral Court (TSE) as an atypical form of abuse of power. This article analyzes and discusses the TSE's current understanding of the abuse of power of religious authority. The analyzed sample brought together five TSE judgments handed down between 2016 and 2021. The results obtained allow us to affirm that the Electoral Court, at this moment, understands that the abuse of power of religious authority cannot be examined in the Judicial Investigation Action Electoral as an autonomous figure of abuse of power, since neither the Constitution nor the electoral legislation contemplates the figure of abuse of religious power. However, the Court admits the analysis of the abuse of religious power, if correlated with any of the typical forms of abuse of power.
