Crimes contra a honra praticados por fake news : uma ameaça a democracia e a participação política

Abstract

Realiza uma análise, sob a ótica do ciberativismo, da democracia 2.0 e da ameaça que as fake news lhe representam ao visarem à destruição da reputação de determinado indivíduo pelo cometimento dos crimes de calúnia, injúria ou difamação. Analisa se como a internet transformou a democracia ao permitir a horizontalização da informação e a realização de protestos organizados. O artigo utiliza a pesquisa bibliográfica e o método indutivo para chegar à conclusão da necessidade de atualização da legislação penal para contemplar as fake news no âmbito dos crimes contra a honra.

It produces an analysis, from the point of view of cyber-politics, democracy 2.0 and of the threat that the fake news present when aiming at the ruin of the reputation of a certain individual for the crimes of slander, injury or defamation. It analyzes how the internet has transformed democracy by allowing the horizontalization of information and the carrying out of organized protests. The article uses literature review and the inductive method, reaching the conclusion of the need to update the penal legislation to contemplate fake news in the scope of crimes against honor.
