Atuação da Justiça Eleitoral em São Paulo: estudo de caso do parecer da procuradoria nas eleições de 1934

Abstract

Analisa o Parecer da Procuradoria a propósito das eleições de 1934, documento que mostra a atuação da Justiça Eleitoral brasileira logo após sua implementação com o Código Eleitoral de 1932. A partir da leitura do Parecer, busca-se entender as denúncias de fraudes ocorridas nas eleições da época e a adaptação e reconfiguração das supostas fraudes em um cenário marcado por novas regras e mecanismos institucionais da Justiça Eleitoral. Além disso, também é discutido o papel da Procuradoria como órgão de controle jurídico criado para garantir maior legitimidade às eleições e que acabava tendo um papel de mediação entre os interesses dos partidos e as novas regras criadas. A análise revela que os partidos e agentes políticos encontraram novas maneiras de manipulação dos resultados eleitorais, mostrando a capacidade de adaptação deles ao novo sistema eleitoral e, sobretudo, à criação da Justiça Eleitoral.

It analyzes the 1934 Prosecutor's Opinion, a document that shows the actions of the Electoral Justice shortly after its implementation with the 1932 Electoral Code. Based on a reading of the Opinion, we seek to understand the allegations of fraud in the elections and the adaptation and reconfiguration of the alleged fraud in a scenario marked by new rules and institutional mechanisms of the Brazilian Electoral Justice. In addition, we also discuss the role of the Prosecutor's Office as a legal control body created to ensure greater legitimacy in elections. The analysis reveals that political parties and agents found new ways to manipulate election results, highlighting the limits of the attempt to modernize the electoral system with the creation of the Electoral Justice and, at the same time, the role of the Prosecutor's Opinion, which ended up mediating between the interests of the parties and the new rules that were created.
