Participação da pessoa com deficiência intelectual ou mental curatelada no processo eleitoral brasileiro : o direito político de ser votada

Abstract

Analisa-se o direito político de candidatura da pessoa com deficiência intelectual ou mental curatelada, instituído pela Convenção Internacional sobre os Direitos das Pessoas com Deficiência, internalizada no Brasil como emenda constitucional. Problematiza-se como tal direito subsiste à regra de sua perda ou suspensão por incapacidade civil absoluta, prevista no art. 15, II, da Constituição da República Federativa do Brasil. Parte-se da contextualização dos direitos políticos das pessoas com deficiência e passa-se à análise da temática nas Constituições brasileiras, na Convenção e na Lei no 13.146/2015 no que se refere às alterações promovidas no regime das incapacidades, com reflexos na curatela para as deficiências intelectual e mental. Os resultados da revisão bibliográfica, legislativa e jurisprudencial evidenciam descompassos entre a Lei Brasileira de Inclusão, a Convenção que lhe dá suporte e o texto constitucional, bem como a ausência de enfrentamento do assunto pelos tribunais.

It analyzes the political right of candidacy of the person with intellectual or mental disability under guardianship, instituted by the International Convention on the Rights of Persons with Disabilities, internalized in Brazil as a constitutional amendment. It is questioned how such right subsists the rule of its loss or suspension due to absolute civil incapacity, foreseen in art. 15, II, of the Constitution of the Federative Republic of Brazil. It starts from the contextualization of the political rights of people with disabilities, goes on with an analysis of the theme in the Brazilian Constitutions, in the Convention and in Law n. 13.146/2015 with regard to the changes promoted in the disability regime, with reflexes in the curator for the disabled, intellectual and mental disabilities. The results of the bibliographic, legislative and jurisprudential review show mismatches between the Brazilian Inclusion Law, the Convention that supports it and the constitutional text, as well as the lack of confrontation of the subject by the courts.
