Constituição, constituinte exclusiva e reforma do sistema representativo : procedimentos, veto players e mudanças constitucionais

Abstract

Analisa a proposta de uma Assembleia Constituinte exclusiva como meio de realizar a reforma da representação política no Brasil. Conclui-se que reforma por essa via é questionável tanto quanto à constitucionalidade quanto à possibilidade de êxito em forjar instituições dotadas de conteúdo qualitativamente superior às criadas pelo constituinte reformador. É equivocado supor que contexto e regras eleitorais que elegeriam uma Constituinte exclusiva levariam ao poder representantes virtuosos, magnânimos e de racionalidade desinteressada, se comparadas ao contexto e às regras que elegem legisladores ordinários. Conclui-se também que as propostas de reformas apresentam dois modelos alternativos: a representação proporcional de lista fechada e a representação distrital mista. Os dois modelos gerariam maiores incentivos à responsabilização dos representantes e à construção de coalizão, mas a primeira teria maior probabilidade de êxito por ser uma reforma incremental.It analyzes the proposal for an exclusive Constituent Assembly as a means of carrying out the reform of representation in Brazil. It is concluded that reform in this way is questionable not only in terms of constitutionality, but also in terms of the possibility of success in forging institutions endowed with qualitatively superior content to those forged by the reforming constituent. It is a mistake to suppose that the electoral context and rules that will elect an exclusive Constituent would bring to power virtuous, magnanimous and disinterested rational representatives, if compared to the electoral context and rules that elect ordinary legislators. It is also concluded that the reform proposals present two alternative models: the closed list proportional representation and the mixed district representation. Both models generate greater incentives for representative accountability and coalition building, but the former will be more likely to succeed because it is an incremental reform.
