Resumo
Analisa a atividade legislativa dos partidos políticos no Senado brasileiro, especificamente no que concerne a apresentação de projetos de lei. O estudo concentra-se
nos projetos de lei ordinária e complementar, projetos de resolução
e propostas de emenda constitucional apresentados no Senado no
período compreendido entre 1995 e 2010. O foco central do estudo
é mapear quantitativamente a atividade legislativa dos partidos
e identificar o nível de agregação (entendida como amplitude/
abrangência) dos projetos de lei apresentados, classificando-os em:
individual, local, regional, setorial, nacional e federativo. Por meio
de técnicas descritivas e do cruzamento de dados confirmou-se a
hipótese central de que a apresentação de proposições nacionais
(que difundem benefícios a toda sociedade) independe dos partidos
políticos. Problematiza-se que a apresentação de projetos de lei
nacional dos partidos não é real um indicativo que as legendas
estruturam o comportamento legislativo dos seus parlamentares
em torno de questões e interesses nacionais, antes, porém, uma
característica do processo legislativo fortemente condicionado
pelos entraves constitucionais à legislação distributivista.
It examines the legislative activity of political parties in the Brazilian Senate, specifically regarding the submission of law projects. The study focuses on projects of ordinary and complementary laws, resolution projects and constitutional amendment proposals submitted to the Senate between 1995 and 2010. The study focuses on the quantitative assessment of the legislative activity of the parties and identifies the level of aggregation (understood as range/coverage) of the law projects presented, classifying them into: individual, local, regional, sectorial, national and federal. Through descriptive techniques and data crossing the study has confirmed the central hypothesis that the presentation of national propositions (those that diffuse benefits to the entire society) is independent of political parties. It demonstrates that the presentation of national law projects by the political parties is not a real indication that such parties structure the legislative behavior of its members around matters of national interest. To the contrary, it is rather a trait of the Brazilian legislative process, strongly influenced by barriers of constitutional law to pork barrel legislation.
