Jurisdição Eleitoral : constitucionalização e judicialização da política e das relações sociais

Abstract

Analisa a jurisdição eleitoral no Brasil à luz da constitucionalização e da judicialização das relações sociais e políticas, com foco no papel da Justiça Eleitoral na legitimação do processo político-eleitoral. Para tanto, foi adotada uma abordagem metodológica descritiva e exploratória, com base em revisão bibliográfica e análise documental sobre a evolução do Estado Democrático de Direito e a atuação normativa e fiscalizadora da Justiça Eleitoral. A análise indica que a Justiça Eleitoral desempenha um papel central na manutenção da legitimidade do processo eleitoral, ao regulamentar e fiscalizar as eleições, além de enfrentar novos desafios, como o impacto das plataformas digitais na desinformação e no discurso de ódio. Assim, a conclusão é no sentido de que a expansão do ativismo judicial, embora necessária em determinadas circunstâncias, deve ser aplicada com cautela para não comprometer a soberania popular e a legitimidade do sistema democrático. A jurisdição eleitoral, portanto, enfrenta o desafio de equilibrar suas funções fiscalizadoras com a preservação da vontade popular, em um cenário de crescente complexidade social e tecnológica.

It aims to analyze electoral jurisdiction in Brazil in light of the constitutionalization and judicialization of social and political relations, focusing on the role of the Electoral Justice in legitimizing the electoral process. For this purpose, a descriptive and exploratory methodological approach was adopted, based on a literature review and document analysis regarding the evolution of the Democratic Constitutional State and the regulatory and supervisory actions of the Electoral Justice. The results indicate that the Electoral Justice plays a central role in maintaining the legitimacy of the electoral process by regulating and overseeing elections, while also facing new challenges, such as the impact of digital platforms on misinformation and hate speech. It is concluded that the expansion of judicial activism, although necessary in some circumstances, should be applied with caution to avoid compromising popular sovereignty and the legitimacy of the democratic system. Therefore, electoral jurisdiction faces the challenge of balancing its supervisory functions with the preservation of popular will in a context of increasing social and technological complexity.
