O Brasil no combate à compra de votos nas eleições

Abstract

Considerando a conduta de compra de votos como realidade no contexto brasileiro, bem como a ausência de expressiva atuação estatal preventiva, este artigo apresenta estudo sobre a corrupção eleitoral que engloba a captação ilícita de sufrágio, levantando a discussão e apresentando propostas de atuação do Estado e da sociedade para o combate da conduta referida. O método utilizado se baseia na análise de institutos jurídicos relacionados à democracia e no agrupamento de resultados de pesquisas e dados estatísticos divulgados pelo Tribunal Superior Eleitoral (TSE). Conclui pela necessidade de implementação de ações preventivas pelo Estado, sobretudo pela Justiça Eleitoral e polícia judiciáriaConsidering the vote buying as a reality in the Brazilian context and the absence of significant preventive state action, this paper shows a study about electoral corruption, involving the illegal capture of suffrage, raising the discussion and presenting action proposals of State and society to combat that buying. The method used is based on the analysis of legal institutions related to Democracy and grouping of search results and statistical data released by the Supreme Electoral Tribunal. It concludes with the need of implement preventive actions by the State, especially Electoral Justice and Judiciary Police
