Democracia e cassação de mandato pela Justiça Eleitoral

Abstract

Trata das transformações ocorridas no modo de atuação do Poder Judiciário com a Constituição de 1988 e como isso gerou um protagonismo do mesmo. Esse protagonismo, que serve justamente para garantir o respeito à normatividade, em certos momentos pode acabar por ferir a participação e a vontade popular, como no caso de cassação de mandatos pela Justiça Eleitoral. Assim, citam-se alguns pontos que buscam resgatar a participação da sociedade, como os amicus curiae.It describes the transformations that have occurred in the activity of the judiciary since the Constitution of 1988 and how this has generated judicial protagonism. This protagonism, which serves to guarantee respect for the rules, can at certain moments injure popular participation and expression of the will of the people, as is the case of removal from office by the electoral courts. Hence, we mention some aspects that seek to preserve the participation of society, such as the amicus curiae.
