Do voto ao presidencialismo de coalizão : democracia em crise?

Abstract

Analisa a função do povo em uma democracia, destacando as formas de representação política no Brasil, com ênfase na representação indireta, que ocorre através dos partidos políticos. Também, analisar-se-ão as questões que envolvem o multipartidarismo, o presidencialismo de coalizão e a relação existente entre os Poderes Executivo, Legislativo e Judiciário, com vistas a demonstrar alguns dos fundamentos para a crise existente no país. O complexo sistema envolvendo o voto, os partidos políticos, o presidencialismo de coalizão e a atuação dos três Poderes, com destaque para o Poder Judiciário, revela uma crise estrutural na qual o povo, que é o titular do poder, fica cada vez mais desacreditado com a atuação das instituições. A análise doutrinária realizada tem por premissa que a teoria majoritária da democracia não pode ser o único fundamento para a ocorrência da democracia, e que o presidencialismo de coalizão desempenha importante papel na atual conjuntura política brasileira para que se tenha uma governabilidade. Conclui-se, então, que entre o voto e o presidencialismo de coalizão existe uma longa e complexa relação, que impossibilita fazer prevalecer o sentimento coletivo capaz de suscitar a plena cidadania.

It aims at analyzing the role of the people in a democracy, showing the forms of political representation in Brazil, with emphasis on indirect representation by political parties. Issues involving multipartisanship, coalition presidentialism, and the relationship between the Executive, Legislative, and Judiciary Branches will be analyzed, with a view to demonstrating some of the foundations for the crisis in the country. The complex system involving voting, political parties, coalition presidentialism, and the performance of the three Powers, with a prominent role for the judiciary, reveals a structural crisis, in which the people, who hold the power, are increasingly more discredited by the performance of the institutions. The doctrinal analysis conducted is based on the premise that the majority theory of democracy cannot be the sole basis for the occurrence of democracy, and that coalition presidentialism plays an important role in the current Brazilian political conjuncture to achieve governability. It is concluded, then, that there is a long and complex relationship between the vote and the coalition presidentialism, which hinders the prevalence of a collective feeling capable of raising full citizenship.
