Análise da legitimação ativa do eleitor na ação de impugnação ao mandato eletivo

Abstract

Trata-se de uma análise da Constituição da República (CR/88), no que diz respeito a previsão da possibilidade da Ação de Impugnação do Mandato Eletivo (AIME) daquele que se consagra vencedor das urnas mediante corrupção, fraude ou abuso do poder econômico. Visando, justamente, preservar a normalidade e legitimidade das eleições. Entre muitas querelas, o presente estudo se concentra em analisar, exclusivamente, a possibilidade de o eleitor ajuizar a ação impugnatória de mandato prevista por nossa carta Magna.This article presents a analysis of the Constitution of the Republic (CR/88) what concerns foresight of the possibility of the Accion of Impugnation of Elective Mandate in cases which the winner of the urns dedicates to means of corruption, fraud or abuse of economical power. Aiming, just, to preserve the normality and legitimacy of the elections. Between many disputes, the present study is concentrated in analysing, exclusively, the possibility of the citizen judging the action of refuting the mandate, which is predicted on the Constitution.
