Dez anos de lei da ficha limpa : o que a democracia brasileira tem a dizer

Abstract

Investiga se a Lei da Ficha Limpa alcançou os objetivos de sua edição, melhorando a percepção sobre a política no país e retirando da disputa os considerados inaptos ao exercício da função. Para tal, foram utilizados os dados do Estudo Eleitoral Brasileiro - ESEB dos anos de 2002, 2010, 2014 e 2018, a fim de aferir a adesão à democracia e a percepção sobre a corrupção. Para a análise sobre os excluídos do pleito pela referida lei, teve-se como base os dados fornecidos pelo Tribunal Superior Eleitoral. Ao final foi possível concluir, ao menos de maneira superficial, que a restrição de direitos trazida pela Lei Complementar nº 135/2010 não logrou êxito em melhorar a adesão à democracia no Brasil. Com efeito, como não foram rodados testes estatísticos de correlação, dada a inexistência de variáveis confiáveis para o teste, é possível que outros fatores tenham contribuído para o descrédito das instituições no país, não podendo ser atribuído apenas à ineficácia da norma em "moralizar" a política brasileira.

It investigates whether the Clean Record Law achieved the objectives of its edition, improving the perception of politics in the country and removing those considered unfit from exercising the function from the dispute. The study uses data from the Brazilian Electoral Study - ESEB of the years 2002, 2010, 2014 and 2018 in order to assess adherence to democracy and the perception of corruption. For the analysis of those excluded from the election by that law, the data was provided by the Superior Electoral Court. In the end, it was possible to conclude, at least superficially, that the restriction of rights brought about by Complementary Law 135/2010 did not succeed in improving adherence to democracy in Brazil. Indeed, as statistical correlation tests were not run, given the lack of reliable variables for the test, it is possible that other factors contributed to the discrediting of institutions in the country, and cannot be attributed only to the ineffectiveness of the standard in "moralizing" brazilian politics.
