Segurança jurídica em tempos de pandemia : análise da consulta ao TSE sobre inelegibilidade e adiamento das eleições

Abstract

Investiga o conteúdo do princípio da segurança jurídica na seara eleitoral mediante a análise do tratamento que foi dado pelo Tribunal Superior Eleitoral à Consulta nº. 0601143-68, que indagava sobre a permanência ou não da inelegibilidade de candidatos após o adiamento das eleições. Para tanto, vale-se da análise dos argumentos apresentados no respectivo acórdão, que se basearam no princípio da segurança jurídica para justificar tanto a manutenção quanto a superação de entendimentos jurisprudenciais sedimentados no Tribunal Superior Eleitoral.

It investigates the content of the principle of legal certainty in the electoral field by analyzing the treatment that was given by the Superior Electoral Court to Consultation no. 0601143-68, which asked whether or not candidates remained ineligible after the elections were postponed. For that, it uses the analysis of the arguments presented in the respective judgment, which were based on the principle of legal certainty to justify both the maintenance and the overcoming of jurisprudential understandings established in the Superior Electoral Court.
