Poder regulamentar da justiça eleitoral : aspectos legais e constitucionais

Abstract

Sabe-se que o Direito Eleitoral conta com um importante instrumento para regulamentação e viabilização prática das disposições legais: As resoluções do Tribunal Superior Eleitoral. Por outro lado, são recorrentemente levantadas importantes discussões jurídicas sobre a legitimidade e extensão do Exercício do Poder Regulamentar da Justiça Eleitoral, contrastadas em face de alegações de eventuais usurpações das competências inerentes ao Poder Legislativo. A fim de elucidar a questão, o presente estudo tem como objetivo a abordagem sobre a conveniência, necessidade e validade jurídica do Poder Regulamentar da Justiça Eleitoral, apreciando a temática sob o aspecto legal e Constitucional à luz do princípio da Separação dos Poderes e da Teoria das Normas Jurídicas.

It is known that Electoral Law has an important instrument for the regulation and practical feasibility of legal provisions: The resolutions of the Superior Electoral Court. On the other hand, important legal discussions are recurrently raised about the legitimacy and extension of the Exercise of Regulatory Power of Electoral Justice, contrasted in the face of allegations of possible usurpation of the competences inherent to the Legislative Power. In order to elucidate the issue, this study aims to approach the convenience, necessity and legal validity of the Regulatory Power of Electoral Justice, assessing the issue under the legal and Constitutional aspect in light of the principle of Separation of Powers and Theory of the Legal Rules.
