A força democrática das Supremas Cortes

Abstract

Trata da ascensão das Constituições, do constitucionalismo democrático e das Supremas Cortes, com o objetivo de descobrir o quanto estas ascenderam na escala dos Poderes e em que medida contribuem para o fortalecimento da democracia. A pesquisa é descritiva, explicativa, indutiva e bibliográfica, com técnica de documentação indireta, justificada pela importância de definir a atual posição do Poder Judiciário no cenário democrático e pela necessidade de aperfeiçoamento constante da democracia. Conclui-se que as Cortes Supremas também representam o povo, embora seus membros não se cubram com o manto do sufrágio; e que, frequentemente, contribuem para a evolução democrática da sociedade, para a impulsão da história e para o processo civilizatório.

It aims to discuss the rise of Constitutions, of the democratic constitutionalism and of the Supreme Courts, with the objective of discovering how much they have risen in the scale of powers and what was their extension to contribute to the strengthening of democracy. The research was descriptive, explanatory, inductive and bibliographical, with indirect documentation technique, justified by the importance of defining the current position of the Judiciary in the democratic scenario and by the need for constant improvement of democracy. It concludes that the Supreme Courts also represent the people, although their members do not cover themselves with the mantle of suffrage and, frequently, they contribute to the improvement of democracy, to the impetus of history and to the civilizing process.
