Inelegibilidades : questões polêmicas

Abstract

A interpretação da legislação referente às causas de inelegibilidade tem sido motivo de grande preocupação no meio jurídico e político. As constantes mudanças no entendimento da Justiça Eleitoral acerca dos dispositivos relacionados às causas de inelegibilidade tem gerado enorme insegurança para os diversos atores do processo eleitoral. Muitas das decisões proferidas acabam por impor restrição à capacidade eleitoral passiva, que é um dos atributos dos direitos políticos, direito fundamental previsto em nosso ordenamento jurídico. A capacidade eleitoral passiva é um direito fundamental subjetivo que deve ser protegido. A interpretação das normas a ele relacionadas deve ser feita sempre de modo a garantir o pleno exercício do direito à elegibilidade. É nesse sentido que o presente artigo está direcionado, ao analisar diferentes situações relativas às causas de inelegibilidades, mormente quanto às regras previstas na legislação eleitoral que visam assegurar o deferimento de registro de candidatura quando tais empecilhos possam ser removidos a tempo e modo, destacando-se o estabelecido no artigo 26-C, da LC 64/90 e § 10, do artigo 11, LE.

The interpretation of the law regarding the causes for ineligibility to run for elective office has been a subject of great concern among the legal community and in political circles. The constant changes in the interpretation by the electoral courts of the legal provisions on ineligibility to hold office has generated huge insecurity for various actors in the electoral process. Many of the decisions rendered have imposed restrictions on the right of people to hold office (and of voters to choose their representatives), a fundamental right in our legal system. The capacity to hold office is a fundamental subjective right that must be protected. The interpretation of the rules in this respect must always be done so as to assure the full exercise of the right of eligibility. This is the focus of this article, which analyzes the different situations related to the causes of ineligibility, particularly the rules contained in electoral legislation blocking registration of candidacy when the obstacles can be removed before the election campaign officially starts, highlighting the rules established in Article 26-C of Complementary Law 64/90 and Article 11, § 10, of the Electoral Law
