Expulsão do partido por ato de infidelidade e perda do mandato

Abstract

Trata da fidelidade partidária e de suas modificações decorrentes das decisões recentes do Supremo Tribunal Federal (STF) e do Tribunal Superior Eleitoral (TSE). Nos termos do novo entendimento acerca da matéria, o artigo analisa se a expulsão de partido político por ato de infidelidade implicaria hipótese de decretação de perda do mandato. Expõe que existem duas dimensões da fidelidade partidária. A primeira consiste no objeto de mutação constitucional por parte das cortes, que não enseja a perda do mandato, e a segunda decorre da circunstância de cancelamento da filiação partidária ou troca de partido pelo mandatário, hipótese inocorrente de justa causa, a qual justifica a perda do mandato.It examines the party fidelity and its modifications due to the recent decisions of the STF and the TSE. Under the new understanding of the matter, the article examines whether the expulsion of a political party by an act of infidelity hypothesis would decree a forfeiture of office. It states that there are two dimensions of party fidelity, the first, object of constitutional mutation by the courts, which does not motivate the loss of office, and a second, which arises from the fact of cancellation of party affiliation or exchange of party by the politician, without hypothesis of just cause, which justifies the loss of office.
