Candidatura sub judice e campanha eleitoral : restringibilidade à capacidade eleitoral passiva

Abstract

Parte da gênese do reconhecimento dos direitos fundamentais, desde as liberdades públicas, direitos de primeira geração que florescem no ambiente capitalista do século XVIII, para chegar-se à relação entre o Constitucionalismo contemporâneo, democracia e proteção a direitos fundamentais. Analisa-se brevemente o direito fundamental político de ser votado, e sua garantia nos tratados e declarações internacionais e no plano constitucional interno. São pontuados os aspectos básicos do processo de registro de candidatura, enquanto locus onde se materializa por excelência o direito fundamental em questão. A seguir, analisa-se a restringibilidade de direitos fundamentais e os possíveis parâmetros e limites que a regem, para então defender sua aplicabilidade ao direito ao sufrágio passivo. Consequente à tese defendida seria a possibilidade de que o direito à realização de campanha fosse, ante as circunstâncias do caso concreto, restringido no contexto da candidatura sub judice, como providência cautelar na proteção do interesse público representado pelo voto direto, livre e consciente e ainda, o patrimonial, evitando acesso a fundos de financiamento público por candidaturas temerárias.

It starts from the genesis of the recognition of fundamental rights, from the public liberties, first generation rights that flourish in the capitalist environment of the eighteenth century, to reach the relationship between contemporary Constitutionalism, democracy and protection of fundamental rights. It briefly analyzes the fundamental political right to be voted, and its guarantee in international treaties and declarations and in the internal constitutional plan. The basic aspects of the candidacy registration procedure are underlined as locus where the fundamental right in question materializes par excellence. Then analyzes the restrictiveness of fundamental rights and the possible parameters and limits that govern it, and then defend its applicability to the right to passive suffrage. According to the argument put forward, it would be possible for the right to conduct a campaign to be restricted, in the circumstances of the case, restricted in the context of the candidacy sub judice, as a precautionary measure in the protection of the public interest represented by direct, free and conscious voting, and, the patrimonial, avoiding access to funds of public financing by reckless applications.
