Fake news : regulação ou metarregulação?

Abstract

Tomando como referência teórica principal a sociologia sistêmica desenvolvida por Niklas Luhmann e suas aplicações no Direito, este artigo reflete sobre os desafios para o tratamento jurídico da disseminação de notícias falsas. Aborda primeiramente a coevolução entre formas de sociedade e meios de disseminação da comunicação, delimitando as fake news como fenômeno típico de uma sociedade digital. A seguir, define a emergência da autorregulação privada como uma expressão do Direito contemporâneo e nota a necessidade da metarregulação: de regular (pelo Direito estatal) a autorregulação (privada). Finalmente, analisa o art. 31 do Projeto de Lei das fake news (ou Lei Brasileira de Liberdade, Responsabilidade e Transparência na Internet). Assim, o texto destaca as potencialidades do instituto da "autorregulação regulada" previsto nessa legislação para que sejam construídas experimentalmente normas capazes de disciplinar os comportamentos e as responsabilidades emergentes com o desenvolvimento das novas tecnologias e plataformas digitais.

Taking as main theoretical reference the systemic sociology developed by Niklas Luhmann and its applications in law, this paper reflects about the challenges for the legal treatment of fake news dissemination. It approaches firstly the coevolution between forms of society and media for disseminating communication, defining fake news as a phenomenon typical of the digital society. Then, it defines the emergence of private self-regulation as an expression of contemporary law and notes the need for meta-regulation: for regulating (through state law) the (private) self-regulation. Finally, it analyzes article 31 of the Fake News bill (or Brazilian Law on Freedom, Responsibility and Transparency on the Internet). Thus, the paper notes the potential of the institute of "regulated self-regulation" foreseen in this legislation so that standards constructed experimentally can be capable of disciplining the behaviors and responsibilities emerging with the development of new technologies and digital platforms.
