A concepção de democracia em Ronald Dworking

Abstract

Analisa o instituto jurídico da democracia na visão de Ronald Dworkin. Abordará, inicialmente, as concepções majoritárias e coparticipativas de democracia; as dimensões da democracia (horizontal e vertical), bem como a existência ou não de igualdade (de impacto ou de influência) no poder político. Por conseguinte, analisará a importância de uma democracia dependente para a dignidade dos cidadãos. E, por fim, o papel do controle de constitucionalidade judicial na construção do próprio conceito de democracia dworkiana. A pesquisa, ora desenvolvida, tem caráter teórico-descritivo e viés qualitativo, que é proposto dentro de uma perspectiva crítica e reflexiva. Utiliza-se o método dedutivo e a técnica de pesquisa bibliográfica especializada no assunto pesquisado.

It intends to analyze the legal institute of democracy in Ronald Dworkin's view. It will initially address the majority and co-participant conceptions of democracy; the dimensions of democracy (horizontal and vertical), as well as the existence or not of equality (of impact or influence) in political power. Therefore, it will analyze the importance of a dependent democracy for the dignity of citizens. And, finally, the role of judicial review of constitutionality in the construction of the concept of a Dworkin democracy. The research, now developed, has a theoretical descriptive character and a qualitative bias, which is proposed within a critical and reflective perspective. The deductive method and the technique of bibliographic research specialized in the researched subject are used.
