Abstract

Analisa a ponderação entre o direito ao esquecimento e a liberdade de expressão, no que diz respeito as informações contidas no âmbito da internet, especificamente aquelas que são expressadas de forma ofensiva, com conteúdos ultrajantes e, por vezes, falsos. É cediço que o crescimento desenfreado de novas tecnologias e a facilidade ao acesso à internet potencializaram a disseminação de tais conteúdos vexatórios. Assim, pretende-se demonstrar como o poder judiciário pátrio e estrangeiro tem enfrentado tais situações. Ademais, partindo das premissas axiológicas e deontológicas, pretende-se demonstrar a relação entre o direito ao esquecimento e as chamadas fake news, mensurando a valia do direito pessoal à esquecer, não somente no que diz respeito as questões criminais envolvendo maus antecedentes, mas também no âmbito civil, dando ênfase a esse novo desafio que é apagar da memória e da internet conteúdo falsos e difamatórios que destroem a reputação e a imagem de inúmeras pessoas.It tackles the debate over the relation between right to be forgotten and freedom of speech regarding the scope of information contained on internet, specifically those are expressed offensively with outrageous and false contents. Obviously the unrestrained growth of new technologies also easy internet access maximize dissemination of these kind of contents. It aims at verifying any sort of national and international jurisdictional decisions in these cases. Furthermore starting from axiological and deontological premise, it aims to demonstrate the relation between right to be forgotten and fake news measuring the value of that right, not only involving criminal record but also civil law with emphasis on this new challenge that's delete memories and remove fake contents on the internet that can destroy the reputation of many people.
