Resumo
A fidelidade partidária é inerente à estrutura dos partidos políticos e ao sistema constitucional brasileiro. Entretanto, no mundo fático, verifica-se a troca de agremiação, o que caracteriza o ato de infidelidade partidária. Nessa quadra, o partido político pode buscar, perante a Justiça Eleitoral, a decretação da perda do cargo eletivo com fundamento na Res.-TSE nº 22.610/2007, posteriormente alterada pela Res.-TSE nº 22.733/2008.
Party loyalty is an inherent part of the structure of political parties and of the Brazilian constitutional system. In the real world, however, party affiliations are exchanged, which characterizes the act of partisan infidelity. In this framework, the political party may appeal to the Election Law system to declare the repeal of the elective office based on Res.-TSE N. 22.610/2007, subsequently amended by Res.-TSE N. 22.733/2008.
