Os partidos políticos e o instituto da fidelidade partidária no ordenamento jurídico brasileiro

Abstract

Consoante a Constituição Federal de 1988, a filiação partidária se impõe como uma das condições de elegibilidade na forma do §3º de seu artigo 14. Nesse sentido, embora o citado instituto seja considerado uma condição de elegibilidade, a lei maior não previu originariamente uma sanção aos candidatos eleitos que mudassem de partido sem uma justa causa plausível. O presente artigo objetiva, dessa feita, abordar a fidelidade partidária e as consequências de seu descumprimento no mandado eletivo, sob um enfoque cronológico, nos âmbitos doutrinário, jurisprudencial e legal sobre a matéria. Desse modo, serão analisados os entendimentos do Tribunal Superior Eleitoral e do Supremo Tribunal Federal ao longo do tempo, até a primeira previsão legal, com a publicação da Lei nº 13.165/15, bem como a recente inclusão de novos parágrafos no artigo 17 da Constituição Federal de 1988, através de emendas constitucionais.

This article aims to address the principle of party loyalty and the consequences of its failure to comply with the elective mandate, under a chronological approach, in the doctrinal, jurisprudential and legal scopes on the matter. According to the Federal Constitution of 1988, party affiliation is imposed as one of the eligibility conditions in the form of §3 of its article 14. In this sense, although the aforementioned institute is a condition of eligibility, the Constitution did not originally impose a sanction to elected candidates who change parties without just cause. The objective, therefore, will be to work on the understandings of the Superior Electoral Court and the Federal Supreme Court over time, until the first legal provision, with the publication of Law No. of paragraphs in article 17 of the Federal Constitution of 1988, which deals with political parties, through constitutional amendments.
