Eleições indiretas no atual ordenamento jurídico nacional : contradições, excepcionalidades e incertezas

Abstract

Discute a inserção da eleição indireta para o Poder Executivo no atual ordenamento jurídico nacional, por meio do estudo de decisões judiciais, propostas legislativas, contribuições de intérpretes e hermenêutica de normas legais. Analisa a previsão existente na Constituição da República Federativa do Brasil de 1988 (CRFB) para o cargo de Presidente, as condições excepcionais que a motivam, as tentativas e as possibilidades de modificar tal determinação e regulamentá-la, caso algum dia se torne necessário efetivá-la. De igual forma, debate como tem sido disciplinada e realizada a eleição indireta pelos entes subnacionais, com especial atenção ao modo como o Judiciário se tem manifestado sobre o tema, as nuances de suas interpretações e os impactos que essas variações têm produzindo na efetivação de tais pleitos. Por fim, observa a inexistência de coerência no modo como a questão da eleição indireta está regulamentada ou tem sido interpretada especialmente pelos diferentes entes federativos, na vigência da CRFB.

It discusses the insertion of the indirect election for the executive power in the current national legal system, through the study of judicial decisions, legislative proposals, contributions of interpreters and hermeneutics of legal norms. It analyzes the existing prevision in the Federal Constitution of 1988 for the President of the Republic position, the exceptional conditions that motivate it, the attempts and the possibilities to modify such determination, the alternatives for regulating it, in case someday becomes necessary to carry it. Likewise, it debates how the indirect election has been disciplined and carried out by subnational entities, with special attention to the way in which the Judiciary has been manifesting itself on the subject, the nuances of their interpretations and the impacts of these variations has been producing in the effectuation of such claims. Finally, it observes the absence of coherence in the way in which the issue of indirect election is regulated or has been interpreted in the context under the 1988 Constitution, notably in the comparison between the different federative entities.
