Limites à liberdade de expressão no Brasil : (quando) é preciso falar a verdade?

Abstract

Busca identificar se a liberdade de expressão encontra limites no ordenamento jurídico e no constitucionalismo brasileiro, sejam limites explícitos, construídos jurisprudencialmente ou, mesmo, implícitos, decorrentes da interpretação constitucional. Questiona-se, ainda, se, dentre os possíveis limites implícitos à liberdade de expressão, se estabelecem, e em que circunstâncias, a vedação ao discurso de ódio e os ataques à Democracia e o direito à verdade e/ou a vedação à mentira, em especial ante o contexto da massificação dos meios de comunicação e a disseminação ardilosa e massiva de notícias fraudulentas com o objetivo de alcançar vantagens políticas e econômicas indevidas. Chega-se, em conclusão, a respostas positivas a esses questionamentos, delineando-se, a partir de uma extensa, mas não terminativa, revisão bibliográfica, legislativa e jurisprudencial, bem como, do exercício hermenêutico-constitucional, as restrições à livre expressão encontradas na lei, na jurisprudência do Supremo Tribunal Federal e nas entrelinhas da Constituição.

It seeks to identify whether free speech finds limits in the Brazilian constitutionalism and legal system, whether explicit limits, constructed in jurisprudence or even implicit, resulting from constitutional interpretation. It is also questioned whether, among the possible implicit limits to free speech, the prohibition against hate speech and attacks on democracy and the right to truth and/or the prohibition against lies are established, and under what circumstances, especially in light of the mass media context and the cunning and massive dissemination of fraudulent news with the aim of achieving undue political and economic advantages. In conclusion, we arrive at positive answers to these questions, outlining, based on an extensive, but not exhaustive, bibliographical, legislative and jurisprudential review, as well as, from the hermeneutic-constitutional exercise, the restrictions on free speech found in the Law, in the Jurisprudence of the Federal Supreme Court and between the lines of the Constitution.
