Constitucionalidade das restrições infraconstitucionais à capacidade eleitoral passiva

Abstract

Os direitos políticos fundamentais ativos - ser eleitor - ou passivos - ser candidato - recebem da Constituição o seu regramento. Relativamente à capacidade passiva, a norma constitucional estabelece, com exclusividade, as condições de elegibilidade, mas também prevê causas de inelegibilidade expressas e outras, com vistas a tutelar vetores como probidade administrativa, moralidade para o exercício do mandato, normalidade e legitimidade das eleições, que são remetidas para Lei Complementar, restringindo o direito político fundamental de ser candidato. O estudo da constitucionalidade de tais inelegibilidades infraconstitucionais passa pela análise dogmática da força eficacial e da densidade normativa da referida norma constitucional (art. 14, §9ª, CF), concluindo-se que a dimensão dos vetores por ela tutelados justifica a construção de uma norma de eficácia contida ou limitada e de baixa densidade normativa, concluindo-se pela constitucionalidade das LC ns. 64/1990 e 135/2010.

Active fundamental political rights - being a voter - or passive - being a candidate - are governed by the Constitution. To the passive capacity, the constitutional norm exclusively sets out the conditions of eligibility, but also provides expressed and other causes of ineligibility, tending to protect the vectors such as administrative probity, morality for the exercise of the mandate, normality and legitimacy of elections, are referred to Complementary Act, restricting the fundamental political right to be a candidate. The study of the constitutionality of such under Constitutional law ineligibilities goes through the dogmatic analysis of the efficiency force and the normative density of the referred constitutional norm (art. 14, §9ª), concluding that the dimension of the vectors under its protection justifies the construction of a contained or limited efficacy standard and low normative density, concluding by the constitutionality of the Complementary Acts 64/1990 and 135/2010.
