O recadastramento biométrico como instrumento de violação do direito constitucional ao voto secreto

Abstract

Examina a política de recadastramento biométrico promovida pelo Tribunal Superior Eleitoral, especificamente quanto ao direito constitucional ao voto secreto. Para tanto, utilizando o método indutivo e a pesquisa bibliográfica de livros e artigos científicos publicados em periódicos nacionais e estrangeiros, confirma a hipótese da existência de risco ao direito fundamental ao voto secreto causado pelo recadastramento biométrico de eleitores promovido pelo Tribunal Superior Eleitoral, demonstrando que a tecnologia de votação eletrônica é passível de fraudes porque expõe importantes dados pessoais e eleitorais. A pesquisa conclui que apenas uma total desvinculação da máquina que identifica o eleitor com a máquina que registra o voto pode garantir a proteção da escolha feita pelo eleitor.

It studies the biometric registration policy promoted by the Brazilian Electoral Superior Court, specifically regarding the constitutional right to secret ballot. Therefore, applying the inductive method and the bibliographic research of books and scientific articles published in Brazilians and foreign journals, confirm the hypothesis of jeopardizing the fundamental right to secret ballot due to the elector biometric registration requested by the Brazilian Electoral Superior Court, demonstrating that the electronic voting technology may be frauded because it exposes important personal and electoral data. The research concludes that only a complete untying of the machine that identifies the elector and the machine that register the vote can guarantee the protection of the elector's choice.
