No império das leis : atuação e perfil econômico-social dos juízes de paz. (Mariana, Minas Gerais, 1828-1848)

Abstract

Analisa a inserção dos juízes de paz na legislação dirigida ao sistema eleitoral da primeira metade do século XIX. Nestes termos, o corte temporal compreende os regulamentos eleitorais que fortaleceram enormemente o papel dos juízes de paz na administração das eleições municipais. Destacam-se, especialmente, as normatizações de 1828, 1842 e 1846. De forma secundária assinala-se o aparato judiciário a partir das prerrogativas do Código do Processo Criminal de 1832 e da Lei que o reformou em 1841. Essas normas também consideraram as funções dos juízes de paz. O recorte espacial abarca o município de Mariana que no período encarou mobilizações políticas importantes. A pesquisa documental envolveu a análise das atas de eleições, um registro criminal, inventários e listas nominativas. Buscamos observar a complexidade possível entre o encontro do poder atribuído aos juízes de paz enquanto autoridades locais e a legislação implementada pela política imperial.It analyzes the insertion of justices of the peace in the legislation addressed to the electoral system of the first half of the nineteenth century. Accordingly, the temporal cut comprises the electoral regulations for the role of magistrates in the administration of municipal elections. It observes the prerogatives of 1828, 1842 and 1846. Secondarily pointed out the judicial apparatus from the prerogatives of the Criminal Code of 1832 and the law that reformed in 1841. These laws also considered the functions of justices of the peace. The spatial area includes the town of Mariana in the period was the scene of important political mobilizations. The documentary base involved the analysis of the minutes of elections, a criminal case, inventories and word lists. The text points out the complexity possible between the date of the power attributed to justices of the peace as local authorities and legislation implemented by the imperial policy.
