A sub-representação de gênero no Poder Legislativo brasileiro : apontamentos de direito comparado

Abstract

Aborda, sob a perspectiva histórica e de evolução normativa, os elementos sociais que levaram ao desenvolvimento de ações afirmativas no Brasil e no mundo, bem como sua aplicação e efetividade no cenário legislativo, a fim de minorar a sub-representação feminina. Após a análise das primeiras iniciativas legislativas voltadas à reserva de vagas para mulheres no cenário político brasileiro ainda em 1995, o presente artigo passa a examinar a razão pela qual o percentual de mulheres candidatas e mandatárias segue pouco expressivo, quais dificuldades são encontradas no momento da candidatura e quais são os obstáculos, sob a perspectiva de gênero, para a manutenção de uma mulher em seu cargo. Por fim, são tecidas considerações sobre a minirreforma eleitoral proposta em 2023, ora apresentada pelo Grupo de Trabalho da Câmara dos Deputados no âmbito do PL 4438/23 e PLP 192/23, com abordagem sobre seus possíveis impactos na promoção de igualdade das mulheres nos espaços legislativos.

It aims to address, from a historical and normative perspective, the social factors that have contributed to the development of affirmative action policies in Brazil and around the world. It explores their implementation and effectiveness within legislative contexts, with the overarching goal of reducing the underrepresentation of women. Beginning with an analysis of the initial legislative initiatives dating back to 1995, which sought to reserve political positions for women in Brazil, this article delves into the reasons behind the persistent low percentage of female candidates and representatives. It also investigates the challenges women face when seeking candidacy and the gender-related obstacles they encounter in maintaining their political positions. Finally, the article offers considerations regarding the 2023 mini electoral reform, currently presented by the Working Group of the Chamber of Deputies under PL 4438/23 and PLP 192/23 and explores the potential impact of these proposed reforms on advancing gender equality within legislative spaces.
