Entre direito e política : as procuradorias legislativas e a Teoria dos Sistemas de Niklas Luhmann

Abstract

Tem como escopo abordar a Teoria dos Sistemas de Niklas Luhmann e sua aplicação nas relações entre Direito e a Política, especificamente entre Procuradorias Legislativas e seus respectivos Parlamentos. O objetivo é visualizar o papel daquelas tanto para o sistema jurídico quanto para o sistema político segundo a ótica sistêmica. O método a ser utilizado será o dedutivo, ao basear-se numa teoria geral com o fito de aplicá-la a circunstâncias específicas do Direito brasileiro. Os resultados obtidos demonstram que as Procuradorias Legislativas são organizações importantes para a promoção da celeridade e variabilidade tanto ao sistema jurídico quanto ao político. No entanto, também demonstram que o contato com o sistema Político pode corrompê-las.

It aims to address Niklas Luhmann's Theory of Systems and its application in the relationship between Law and Politics, specifically between the Legislative Advocacy Offices and their respective Parliaments. The goal is to visualize the role of those for both the legal system and the political system according to the systemic perspective. The method that will be used is deductive, based on a general theory aiming to apply it to specific circumstances of Brazilian law. The results obtained demonstrate that the Legislative Advocacy Offices are important organizations for promoting speed and variability in both the legal and political systems. However, they also demonstrate that contact with the political system can corrupt them.
