Resumo
Discute uma das vertentes consequenciais do Estado de Direito enquanto princípio constitucional vigente em Moçambique. O autor parte do princípio de que, num Estado de Direito, vigora a independência do poder judicial, em consequência da separação de
poderes. Prosseguindo, o autor não admite, com base nesses pressupostos, que a justiça seja
morosa, nem que abundem focos de incerteza da justiça. Em incerteza (ou mesmo insegurança)
da justiça, ele refere-se aos desesperados resultados das decisões judiciais (setenças dos
juízes) que, em Moçambique, justificando-se com base na independência do poder judicial
(ou do juiz), aparecem desarticuladas com a lei. E, nesses casos, mesmo quando prejudicam
cidadãos, estes, ou não reclamam (por não saberem) ou reclamam e nada é feito ao magistrado,
como sanção da sua má acção.
O autor defende que num Estado de Direito, como Moçambique, deve haver justiça e isso
passa necessariamente, pela existência de um poder judicial que seja fiscalizado e impulsionado
a trabalhar duro. É isso que significa poder judicial forte
It discusses about one of the aspects that have been considered as consequence of Rule of Law, as current constitutional principle in Mozambique. The author assumes that the rule of law, force the independence of the judiciary, as a result of separation of powers. Continuing, the author admits, based on these assumptions, that justice must not be slow or that abound justice uncertainty outbreaks. In uncertain (or insecurity) of justice, he refers to the desperate results of judgments (Sentences of judges), in Mozambique, justifying based on the independence of the judiciary (or judge) appear disjointed with law. And in these cases, even when obstacles to citizens, these, or do not complain (not knowing) or complain and nothing is done to the magistrate, as a penalty of its wrongdoing. The author argues that the rule of law, such as Mozambique, there must be justice and that necessarily passes by the existence of a judiciary that is monitored and driven to work hard.
