Função normativa da Justiça Eleitoral : uma análise sobre as formas de legitimação da regulamentação das eleições pelo Tribunal Superior Eleitoral

Abstract

Descreve a função normativa da Justiça Eleitoral e defende a existência de algumas formas de legitimação dessa atribuição exercida pela Corte Superior Eleitoral brasileira, com o objetivo de apresentar uma melhor sistematização da matéria, bem como de contribuir para a discussão acerca de sua constitucionalidade. Em primeiro lugar, estuda-se o sistema constitucional de controle jurisdicional das eleições e as peculiaridades da Justiça Eleitoral brasileira, especialmente a sua função normativa. Verificou-se que a Justiça Eleitoral detém a prerrogativa de expedir atos normativos para regulamentar a lei eleitoral ou para inovar em matéria omitida ou insuficientemente tratada pelo legislador, desde que não o faça contrariando as disposições legais já existentes. Concluiu-se que a função normativa da Justiça Eleitoral possui algumas formas de legitimação que são preexistentes à atual Constituição Federal, como a legislativa, a doutrinária, a jurisprudencial e a social. Além dessas formas de legitimação, constatou-se que a função normativa da Justiça Eleitoral possui legitimidade constitucional implícita, a partir de quatro pontos de vista diferentes: em virtude da adoção do sistema constitucional de controle jurisdicional das eleições, conjugada com a teoria dos poderes implícitos; em razão das disposições constitucionais transitórias; em decorrência dos checks and balances na separação dos Poderes; e, por fim, em razão da postura da Suprema Corte diante da atribuição normativa da Corte Superior Eleitoral brasileira.

It describes the normative function of brazilian Electoral Justice and defends the existence of some legitimation forms of this assignment carried out by the brazilian Superior Electoral Court, in order to present a better systematization of the field, and to contribute to the discussion about its constitutionality. First, it is analyzed the constitutional system of jurisdictional control of elections, and the peculiarities of the brazilian Electoral Justice, especially its normative function. It was identified that the brazilian Superior Electoral Court has the prerogative to issue normative acts to regulate the electoral law, or to innovate on the legislature omitted or insufficiently addressed by the legislature, since they do not contrary to the existing legal provisions. It was concluded that the normative function of brazilian Electoral Justice has some forms of legitimacy that are existing prior to the current Federal Constitution, as legislative, doctrinal, jurisprudential and social. In addition to these forms of legitimacy, it was found that the normative function of the brazilian Electoral Justice has implicit constitutional legitimacy, from four different points of view. First, due to the adoption of the constitutional system of elections jurisdictional control, with the theory of implied powers; second, because the transitional constitutional provisions; third, as a result of checks and balances in the separation of powers; and finally, because of the Supreme Court's position on the normative incumbency of the brazilian Superior Electoral Court.
