A tutela inibitória no direito eleitoral e a prevenção ao abuso de poder

Abstract

Busca-se verificar a aplicabilidade ou não da tutela inibitória na prevenção ao abuso do poder, nos termos do CPC/2015 e diante dos bens jurídicos tutelados no direito eleitoral, adotando-se o método doutrinário dogmático, na vertente de lege lata, sob o aspecto dedutivo, através da pesquisa aplicada, descritiva e bibliográfica. Após a análise de doutrina especializada no tema, concluiu-se pela sua aplicabilidade, com fundamento na garantia do acesso à justiça, a partir da tutela jurisdicional adequada da normalidade e legitimidade do pleito.The aim is to verify the applicability or not of the injunction in preventing the abuse of power, under the terms of CPC/2015 and in view of the legal assets protected in the electoral law, adopting the dogmatic doctrinal method, in the lege lata strand, under the deductive aspect, through applied, descriptive and bibliographical research. After analyzing the specialized doctrine on the subject, it was concluded for its applicability, based on the guarantee of access to justice, based on the adequate jurisdictional protection of the normality and legitimacy of the claim.
