Resumo
Situa-se entre os diversos trabalhos dedicados a entender e apresentar
soluções no contexto da erosão democrática experimentada no Brasil desde
julho de 2013, ocupando-se sobretudo da contribuição dos partidos políticos a
este processo. Na democracia, a liberdade do partido em escolher as bandeiras
e desenvolver os projetos na disputa pelo eleitorado e na representação desses
interesses justifica-se pela função de intermediar a relação entre sociedade e
governo. Contudo, não são raras as vezes em que partidos, valendo-se dessa
liberdade, disputam eleições para defender a ruptura com a democracia. Diante deste problema, ocupa-se de demonstrar que o art. 17, caput, da Constituição
Federal (CF/1988) autoriza o cancelamento do registro de partidos políticos
que atuem contra a CF/1988, o que é conduzido à luz das discussões
constituintes e da redação das normas constitucionais e legais que regem os
partidos políticos para chegar à conclusão de que, considerada a insuficiência
dos demais mecanismos de enfrentamento, é autorizado o cancelamento do
registro de partidos com orientação e atuação antidemocráticas pelo Tribunal
Superior Eleitoral (TSE), observado o devido processo legal.
It sides with the many works dedicated to understand and propose remedies to the democratic erosion experienced in Brazil since July 2013, focusing mainly on the contribution of political parties to this process. In democracy, the freedom of the party to choose its flags and develop its projects to dispute the electorate and to represent these interests is justified by its function of intermediating the relationship between society and government. However, it is not uncommon for parties, taking advantage of this freedom, to defend democratic rupture. Faced with this problem, the work is concerned with demonstrating that art. 17, caput, of the Constitution authorizes the deregistration of political parties that act against constitution, what is done in the light of constituent discussions and the wording of constitutional and legal norms that govern political parties, reaching the conclusion that, considering the insufficiency of other mechanisms, the deregistration of parties with an anti-democrat ideology and action is authorized by the Superior Electoral Court, subject to due process of law.
