Sham Litigation e lides eleitorais : uma análise do direito de resposta

Abstract

Analisa de maneira prática litígios eleitorais envolvendo o exercício do direito de resposta em nosso país, por meio de uma reflexão sobre como as ações eleitorais podem tanto ser um meio legítimo para se vindicar direitos quanto uma forma de se abusar do direito de ação e consequentemente embaraçar os trabalhos do Poder Judiciário e prejudicar candidatos adversários no cenário político, precisamente no que tange ao exercício do direito de resposta, configurando-se aquilo que, nos Estados Unidos, foi denominado de Sham Litigation, ou litigância simulada. É abordado, por fim, como se pode tentar resolver ou, no mínimo, mitigar a situação, através de uma política judiciária reflexiva e atenta para evitar abusos processuais ocorrentes em lides eleitorais.

It aims to analyze in a practical way electoral disputes involving the exercise of the right of reply in our country, through a reflection on how electoral actions can be both a legitimate means to vindicate rights and a way to abuse the right of action and consequently hinder the work of the Judiciary and harm adversary candidates in the political scenario, precisely with regard to the exercise of the right of reply, configuring what, in the United States, was called Sham Litigation, or simulated litigation. Finally, it discusses how one can try to resolve or, at the very least, mitigate the situation, through a reflexive and attentive judicial policy to avoid procedural abuses that occur in electoral disputes.
