Diálogos institucionais sobre fidelidade partidária e financiamento de campanhas femininas

Abstract

Examina, sob a perspectiva dos diálogos institucionais acerca da intepretação e da concretização da Constituição, o delineamento legislativo-jurisprudencial da disciplina concernente à fidelidade partidária e ao financiamento de campanhas femininas, transcorridos noventa anos da criação da Justiça Eleitoral e do reconhecimento às mulheres do direito ao voto. Considerando as premissas teóricas do neoconstitucionalismo, a expansão da jurisdição constitucional e o contraponto das teorias da última palavra com as teorias dos diálogos, traz-se à ribalta a contribuição do Congresso Nacional, do Supremo Tribunal Federal e do Tribunal Superior Eleitoral para a evolução e a construção da atual regência concernente à relação entre mandatário e agremiação como mecanismo de coesão e coerência do sistema político, bem assim para a superação da desigualdade de gênero refletida no financiamento de campanhas, a partir da sistemática de cotas.It examines, given the perspective of institutional dialogues around the interpretation and materialization of the Constitution, the statutory and case law framework concerning party loyalty and female campaigns financing, 90 years elapsed after the creation of the Electoral Justice and the recognition of the women's right to vote. Considering the theoretical premises of neoconstitutionalism, the expansion of constitutional jurisdiction and the confrontation between last word theories and dialogue theories, the article sheds a spotlight on the contribution of the National Congress, the Federal Supreme Court and the Superior Electoral Court to the evolution and the construction of the current scenario regarding the relation between mandataries and political parties as a cohesion and coherence mechanism in the political system, as well as to overcome, through the institution of quotas, the reflection of gender inequality in campaign financing.
