Agravo de Instrumento no Recurso Especial Eleitoral Nº 339-86.2016.6.21.0039 : análise sobre o desvirtuamento na aplicação dos recursos do fundo partidário destinado à promoção da participação das mulheres na política

Abstract

Visa à análise sobre o desvirtuamento na aplicação do Fundo Partidário destinado à promoção da participação das mulheres na política. Possui como metodologia o estudo de caso através do acórdão do Agravo de Instrumento (AI) no Recurso Especial Eleitoral (REspE) nº 339.86.2016.6.21.0039 do TSE (Tribunal Superior Eleitoral) considerado pelo TSE como o primeiro a analisar, a luz do art. 30-A da Lei n° 9.504/97, desvio, para campanha masculina, de verbas destinadas à campanha feminina oriundas do Fundo Partidário. A presente análise tem como objetivo aclarar criticamente os conceitos jurídicos empregados em especial os de fraude eleitoral, fraude à lei e boa-fé objetiva. A conclusão busca trazer maior coerência e rigor na aplicação do art. 30-A da Lei nº 9.504/97 em defesa da campanha feminina.It aims to analyze the distortion in the application of the Party Fund aimed at promoting the participation of women in politics. Its methodology is the case study through the judgment of the Interlocutory Appeal (AI) in the Special Electoral Appeal (REspE) nº 339.86.2016.6.21.0039 of the TSE (Superior Electoral Court) considered by the TSE as the first to analyze, in the light of art. 30-A of Law No. 9,504/97, diversion, for the men's campaign, of funds destined for the women's campaign from the Party Fund. The present analysis aims to critically clarify the legal concepts used, especially those of electoral fraud, fraud against the law and objective good faith. The conclusion seeks to bring greater coherence and rigor in the application of art. 30-A of Law nº 9.504/97 in defense of the women's campaign.
