A vitória da democracia brasileira : Lei Complementar n° 135/2010 - "Lei da Ficha Limpa"

Abstract

Analisa o instituto da representação popular e a crise da democracia semidireta, os princípios constitucionais da presunção de inocência ou de não culpabilidade (art. 5°, LVII), o respeito ao direito adquirido e ao ato jurídico perfeito (art. 5°, XXXVI), e o princípio da irretroatividade da lei (art. 5°, XL). Para buscar alicerce internacional, o direito comparado mostrou vários exemplos sobre a inelegibilidade resultante da prática de crimes. Ao final, conclui-se pela constitucionalidade e pela possibilidade de aplicação da "Lei da Ficha Limpa" às eleições que ocorreram no ano de 2010 e as seguintes.It analyzes the institute of the popular representation and the crisis of the semidirect democracy, the constitutional principles of the innocence presumption or of no guilt (art. 5°, LVII), the respect to the acquired right and the perfect legal action (art. 5°, XXXVI), and the principle of the unbackdated of the law (art. 5°, XL). To look for international foundation, the comparative law showed several examples about the ineligibilitys resulting from the practice of crimes. At the end, concludes for the constitutionality and for the possibility of application of the "Lei da Ficha Limpa" to the elections that happened the year of 2010 and the following ones.
