Enfrentamento à desinformação pelo TSE nas eleições de 2022 : análise de julgados de 1º de janeiro de 2022 a 31 de dezembro de 2023

Abstract

Objetiva-se com o texto analisar como se deu o enfrentamento à desinformação pelo Tribunal Superior Eleitoral (TSE), no campo judicial, nas eleições de 2022. Algumas questões de fundo que se colocam são: o TSE explicitou o conceito de desinformação em seus julgamentos? Em quais circunstâncias o TSE entende que a prática desinformativa justifica a não prevalência da liberdade de expressão? Adotou-se uma metodologia analítica dos principais argumentos utilizados pela Corte Superior Eleitoral a fim de nortear a atuação dos diversos interessados no processo político-eleitoral. As principais conclusões são que, para além dos esforços de enfrentamento na esfera administrativa, o TSE foi intensamente demandado do ponto de vista judicial e que a Corte afirmou reiteradamente em seus julgados o direito do eleitor à informação verdadeira, não fraudulenta, não descontextualizada. Nesse sentido, mostrou-se como um dos grandes desafios sopesar a intervenção mínima do Judiciário no debate público e a higidez do ambiente informativo, com isso definindo o que vem a ser considerado conteúdo desinformativo para o Judiciário Eleitoral, destacando-o do exercício regular da liberdade de expressão.

The objective of this text is to analyze how the TSE combated disinformation in the judicial sphere during the 2022 Elections. Some basic questions that arise are: did the TSE make the concept of disinformation explicit in its judgments? Under what circumstances does the TSE understand that the practice of misinformation justifies the non-prevalence of freedom of speech? An analytical methodology was adopted for the main arguments used by the Superior Electoral Court in order to guide the actions of the various interested parties in the political-electoral process. The main conclusions are that, in addition to efforts to confront the issue in the administrative sphere, the TSE was intensely demanded from a judicial point of view, and that the Court repeatedly affirmed in its judgments the voter's right to true, non-fraudulent, non-decontextualized information. In this sense, one of the great challenges has been to weigh up the minimum intervention of the Judiciary in the public debate and the health of the information environment, and thus define what is considered disinformative content for the Electoral Judiciary, setting it apart from the regular exercise of freedom of speech.
