Colonialidade jurídica e violência de gênero na política brasileira

Resumo
A estrutura atual da sociedade brasileira é o reflexo de um padrão de poder colonial
que instituiu um heterocispatriarcado racista, onde prevalece a dominação do homem branco
sobre mulheres, em toda a sua pluralidade. Esse padrão de poder, denominado colonialidade
de gênero, perpetua a subalternidade das mulheres sob uma vertente interseccional, inclusive
na esfera política. Neste espaço, a colonialidade de gênero se manifesta em diversas formas de
violência política contra mulheres, tais como: assédio, constrangimento, humilhação, perseguição
e ameaças, com o objetivo de desqualificá-las e desencorajá-las em sua atuação disruptiva. Tal
situação restringe a participação plena e igualitária das mulheres nos espaços de poder, minando
um dos princípios fundamentais do regime democrático: a representatividade. Além disso, ao
criar um ambiente hostil, desestimula a presença feminina na política e perpetua uma estrutura
excludente e desigual, comprometendo a legitimidade do sistema democrático. Por meio de uma
metodologia jurídico-teórica, baseada na análise de dados qualitativos e quantitativos, revisão
da literatura científica e das legislações, pretende-se demonstrar que, embora as leis de combate
à violência política de gênero sejam importantes marcos jurídicos para o enfrentamento dessa
problemática, elas ainda mantêm a divisão sexual-racial do trabalho instaurada na colonização.
Logo, há necessidade de compreender as lacunas jurídicas geradas pela colonialidade para
garantir a efetividade no combate à violência política de gênero no Brasil e garantir o pleno
exercicío da democracia nos espaços políticos.
The current structure of Brazilian society reflects a colonial power pattern that established a racist heterocispatriarchy, in which white male domination over women, in all their plurality, prevails. This power pattern, known as the coloniality of gender, perpetuates women's subordination through an intersectional perspective, including in the political sphere. In this space, the coloniality of gender manifests in various forms of political violence against women, such as harassment, coercion, humiliation, persecution, and threats, aiming to disqualify and discourage them from engaging in disruptive political actions. This situation restricts women's full and equal participation in power structures, undermining one of the fundamental principles of the democratic regime: representativeness. Furthermore, by creating a hostile environment, it discourages female participation in politics and perpetuates an exclusionary and unequal structure, compromising the legitimacy of the democratic system. Through a legal-theoretical methodology based on the analysis of qualitative and quantitative data, a review of scientific literature, and legislation, this study seeks to demonstrate that while laws combating political gender violence represent important legal milestones in addressing this issue, they still uphold the sexual-racial division of labor established during colonization. Therefore, it is necessary to understand the legal gaps produced by coloniality to ensure the effectiveness of measures against political gender violence in Brazil and to guarantee the full exercise of democracy in political spaces.
