Novos rumos para a democracia representativa no Brasil e a PEC 61/2007 do Senado Federal

Abstract

Trata dos impasses da democracia representativa no Brasil, especialmente após os impactos provocados pelas delações da Operação Lava Jato, a corrosão do sistema representativo e o enfraquecimento das ideologias partidárias. No primeiro capítulo, aborda-se a crise de representatividade que enfrenta o País desde as manifestações de junho de 2013 e o papel dos partidos políticos depois da Constituição de 1988. No segundo, aborda-se a questão dos sistemas eleitorais utilizados em outros países e o sistema proporcional brasileiro, analisando as vantagens e desvantagem do sistema majoritário, proporcional e misto. Por fim, analisa-se a Proposta de Emenda à Constituição no 61/2007, que busca estabelecer o sistema eleitoral misto de voto distrital e lista fechada partidária para o fortalecimento da democracia representativa brasileira, e os novos desafios fundados em tal proposta. Para tanto, utiliza-se do método hipotético-dedutivo, valendo-se das premissas maiores para formação das premissas menores.It deals with the impasses of representative democracy in Brazil, especially after the impacts caused by the "Lava-Jato" operations, the corrosion of the representative system and the weakening of party ideologies. The first chapter dealt with the crisis of representativeness facing the country since the demonstrations in June 2013 and the role of the post-constituent political parties of 1988. In the second chapter, the question of the electoral systems used in other countries and the Brazilian proportional system were analyzed, analyzing the advantages and disadvantages of the majority, proportional and mixed system. Finally, we analyzed the Proposed Amendment to Constitution 61/2007, which seeks to establish the mixed electoral system of district vote, and closed party list for the strengthening of representative Brazilian democracy and the new challenges posed from such proposal. For this purpose, the hypotheticaldeductive method was used, using the larger assumptions for the formation of the smaller premises.
